Better safe than sorry - why a precautionary prenuptial agreement makes sense

When getting married, most couples look to their personal relationship and their future together. However, marriage also entails a large number of rights and obligations. For this reason, it makes sense to deal with the legal consequences of marriage at an early stage. With a notarized marriage contract, these can be adapted to your specific personal circumstances - a tailor-made solution for both good and bad times.

Why single parents should also make a will - preventing an ex-partner from accessing the inheritance

Most popular legal form for business start-ups - How to set up a GmbH quickly and easily

The limited liability company, or GmbH for short, is the most common legal form for business start-ups in Germany. This is due to the many advantages it offers founders: The GmbH legal form is considered trustworthy and is internationally recognized, which makes it easier to find business partners and investors. It is suitable for companies of any size whose business area does not have to be limited to Germany, so there are no limits to future expansion. GmbHs are also separate legal entities, which means, among other things, that the shareholders are not personally liable. There are also tax advantages. Your trusted notary will advise prospective entrepreneurs throughout the entire start-up phase.

The electronic notarial deed - a big step towards the fully digital notary's office

In May of this year, the government draft of a law on the introduction of electronic notarization in person was published. Now that electronic minutes can be drawn up as part of notarial online procedures since 2022, this option will also be available in the future for face-to-face procedures - i.e. when the parties are present in the notary's office. This will close digitization gaps, avoid media disruptions and relieve the burden on notary's offices, courts and other document offices.

Results of the practical check confirm the central role of notaries in the formation of companies and associations

The Federal Chamber of Notaries welcomes the results of the Federal Ministry of Justice's practical check on processes requiring notarization in association and GmbH law (available here). "The report underlines the important role of notaries as a key figure in reducing bureaucratic hurdles for start-ups and proposes that they be established as a central point of contact for the formation of GmbHs and the registration of associations," said Prof. Dr. Jens Bormann, President of the Federal Chamber of Notaries. This further development would not only make processes even more efficient, but would also make a significant contribution to relieving the burden on companies and associations.
